State of North Dakota Notary Requirements

Eligibility

Be 18 years old or older.
Be a citizen or permanent legal resident of the United States.
Be a resident of North Dakota, have a place of employment or practice in North Dakota, or reside in a county that borders North Dakota and is in a state that extends reciprocity to a notary public who resides in a border county of North Dakota.
Be able to read and write in English.

Provisions:

Notary Term
6 years.
Notary Bond
Required. A bond in the amount of $7,500 is required for new and renewing notaries public.
Errors & Omissions Insurance
Optional. Notary Service and Bonding Agency, Inc. strongly recommends that North Dakota notaries insure themselves against claims of negligence.
Notary Stamp/Notary Seal
Required. Rubber inked stamp.
Record Journal
None Required. It is strongly recommended by the Secretary of State and Notary Service and Bonding Agency, Inc. that North Dakota notaries public record every notarial act in a notary record book or journal.
State Filing Fee
A $36.00 filing fee is required for new or renewal notaries.
Education/Testing
None required.
Jurisdiction
Statewide.
Non-Residents
Permitted. A person who resides in a county that borders North Dakota and is in a state that extends reciprocity to a notary public who resides in a border county of North Dakota may apply for a North Dakota notary public commission. The non-resident must designate the Secretary of State as the agent for service of process for all purposes relating to notarial acts, including the receipt of correspondence relating to notarial acts. The non-resident must also complete an Appointment of Agent form.
Notary Commission Renewal
The Secretary of State mails out a renewal notice to each notary public at his or her residence at least 30 days before the expiration of the notary’s current commission.

You must receive a certificate of authorization from the Secretary of State. A copy of this certificate must be presented to us via fax or email. Under state law, a vendor is not authorized to manufacture the notary stamp unless presented with the authorization.
