State of Michigan Notary Requirements

Eligibility

Be 18 years of age or older.
Be able to read and write the English language.
Be a United States citizen or possess proof of legal presence in the United States.
Be a resident within the county applying or for non-residents show proof of employment within the county applying.
Not have been convicted of a felony within 10 years from the date applying; and not be currently imprisoned in any state, county or federal correction facility.
Not have been convicted of two or more misdemeanors for violating the Michigan Notary Public Act within a 12-month period while commissioned, or of three or more such violations within a 5 year period regardless of being commissioned.

Provisions:

Notary Term
6-Year Term. The term is not less than six nor more than seven years from the date of appointment.
Notary Bond
Required. A $10,000 bond is required for new and renewing notaries. The bond must be filed at the office of the county clerk in the county where the notary will be appointed. Licensed attorneys in good standing with the State of Michigan are not required to file a surety bond with the county clerk; however, the state bar number must be included on the application for verification.
Errors & Omissions Insurance
Optional. Notary Service and Bonding Agency, Inc. strongly recommends that Michigan notaries insure themselves against claims of negligence.
Notary Stamp/Notary Seal
None required. A notary public may use a stamp that includes the notary’s commission name, “Notary Public, State of Michigan, County of ______,” “My commission expires________,” and “Acting in the County of _______.” An embosser alone or any other method that cannot be reproduced shall not be used.
Notary Public Recording Journal
Not required. Strongly recommended by The Office of the Great Seal and Notary Service and Bonding Agency, Inc. to keep a notary journal to record the signer's name, signature, identification, date and other pertinent information that a Michigan notary performs.
Education/Testing
Before performing a notarial act, Michigan notaries are required to read the current statutes that regulate notarial acts.
State Filing Fee
A $10.00 state filing fee is required for new notary applications.
Notary Commission Renewal
A notary may apply 60 days before the expiration of his or her current commission by completing a new application form. In the case of an attorney appointed notary public, the Office of the Great Seal will send to the notary, at least 90 days before the commission expires, a reappointment application, which has to be certified by the state bar of Michigan to verify that the notary is still a member in good standing.
Non-Residents of Michigan
Permitted. Non-residents must maintain a place of business in the county of appointment. A person who does not reside in the state of Michigan must demonstrate that his principal place of business is located in the county in which he requests appointment and indicate that he is engaged in an activity in which he is likely to be required to perform notarial acts.

Step 2

We will process your new or renewal notary bond package order and directly email you the following:

Notary public bond.
Notary errors & omissions policy.
Power of attorney form.
Commission expiration date stamp (if ordered).

Step 3

Once you receive your notary public bond in the mail from us you must file it with your County Clerk's office. You have 90 days from the date of the notary public bond to file your notary public bond with the County Clerk's office. Please do not delay!

You must appear in person at your County Clerk's office of the county which you reside or if a non-resident of Michigan, you must file in your county of employment. You will be required to pay the County Clerk’s statutory filing fee; this fee varies in each county.

When at the County Clerk's office the County Clerk will administer an oath of office and verify that you have completed these requirements by completing the designated areas on your completed notary public application for notary public commission. Your original signature must then be placed on the notary public application for notary public commission. Be sure to ask your County Clerk for a receipt to keep for your records.

Note: If you fail to file your notary bond within the 90 days a $15.00 fee will be required to reproduce a replacement notary public bond.

Step 4

Mail the completed notary public application and processing fee to the Michigan Department of State.

Once you have finished the filing requirements at the County Clerk's office, you must forward your completed notary public application for notary public commission with a ($10.00 non-refundable processing fee) to the following address:

Send only a check or money order payable to the "State of Michigan". The Michigan Department of State will review your notary public application for notary public commission approval.

Step 5

Once approved, your notary public commission card (a blue, wallet-sized card) will be mailed directly to your residence address as indicated on the notary public application form.

You can expect to receive your notary public commission card in approximately 2 to 3 weeks by mail. Once received you will be authorized to begin your duties as a notary public for the State of Michigan.

Note: If the notary public application for notary public commission is "not" approved you will receive a denial letter in the mail.

Step 6

PLEASE DO NOT DELAY! Send us a copy of your notary public commission card so we can order your new stamp.

Once we receive a copy of your notary public commission card we will immediately order your new stamp.

NOTE: Please allow up to 3 business days for your stamp(s) to be personalized and manufactured. Once complete the stamp(s) will be mailed directly to you.
